Companies breaking employment laws

Policia Naciocabeceranal, in collaboration with the Provincial inspectorate of Labour and Social Security, have carried out inspections 0n more than 100 companies located in the municipalities of Santa Lucia de Tirajana, Mogán and San Bartolomé de Tirajana in a bid to combat irregular employment and social security fraud. About 40% of the companies inspected were put forward for fines and sanctions due to irregular employment, social security fraud or breach of the rights and freedoms of foreigners.

social-securityNumerous irregularities were uncovered by companies mainly engaged in the services and agriculture sectors and the
results revealed many of the modus operandi used, including the following scams:

  • – The creation of shell companies with no real activity, simulating employment relationships with workers improperly obtaining for them benefits from the Social Security system.
  • – Simulated labour relations in companies with real activity, getting undue social security benefits including unemployment benefits and to obtain or renew residence and foreigners work permits.
  • – the employment of foreign citizens (EU and others), without residence and work permits and some cases of serious irregularities in immigration matters and labour exploitation, serious discrimination in employment and other frauds in connection with the fulfilling of obligations and benefits in Social Security.

About 40% of the companies were proposed for sanctions under Law 13/2012, of 26 December, fighting against irregular employment and social security fraud, in addition to the implementation of the Organic Law 4/2000 of 11 January on the rights and freedoms of foreigners in Spain, particularly those foreigners who were working in these companies without any contract or residing illegally in Spain.
